TERMS AND CONDITIONS OF USE

Object of the Service

Protolab srl provides users (hereinafter “User”, “Users”) of the website daaab.it (hereinafter “daAaB”, “Website”) with the use of the same, which allows searching for travel solutions between two locations (hereinafter “Solutions”) and the eventual purchase of travel tickets (hereinafter “Tickets”) required to use the transport services (hereinafter “Services”) operated by one or more transport companies (hereinafter “Operators”) directly from their own device. After choosing one of the proposed Solutions or directly one of the Tickets from the “Ticket Office” section of the Website, the User can complete their voucher (hereinafter “Voucher”) and proceed with the purchase. These Terms and Conditions govern the use of the Website and may be modified at any time by Protolab srl. The User is required to check the Terms and Conditions before using daAaB.

Methods of Using the Website

Searching for travel Solutions and Tickets on the Website is free of charge and does not require registration. However, registration through one of the proposed channels is recommended for Users to access additional features such as saving favorite locations or routes for convenient subsequent use, or viewing a summary of their Vouchers (valid, to be activated, and expired) for quick reference and re-purchase.

After selecting the desired Solution, the User can proceed to purchase the associated Voucher either after logging into their account or, alternatively, as a non-registered User. In the latter case, the User must provide a valid and active email address to receive the purchased Voucher from daAaB and accepts that this email address will be stored and associated with that Voucher in compliance with the Website's Privacy Policy. The User can choose to make the payment using one of the electronic payment tools available on the Website or, if registered, through their Personal Wallet. The User guarantees that the data entered during login, purchase, and payment operations are truthful and correct, and undertakes to update them in the event of any changes. The User is responsible for safeguarding their personal information related to access and payment data on the Website. daAaB cannot be held liable for any damages resulting from the misuse, loss, or disclosure of such information.

The purchase of Tickets through daAaB does not replace existing traditional or electronic purchase methods adopted by each Operator, but represents an additional channel. It is the responsibility of transport service Users to possess a valid Ticket for their travel, even if it proves impossible to purchase a specific Ticket using daAaB. The purchase of Tickets through daAaB does not involve any additional fees for the User compared to the price of the same types of Tickets purchased through the pre-existing sales channels of each Operator.

To access the Website and use its features, the User must independently provide the necessary tools, internet connections, equipment, hardware, and software. If the local public transport company does not allow printing the ticket, it is the User's responsibility to ensure an active internet connection for the entire duration of the trip to allow Ticket verification by authorized personnel. daAaB is not responsible for providing the User with the aforementioned tools, connections, equipment, or means, nor is it liable for any defects or malfunctions thereof.

Tickets from certain companies require manual activation by the User. If the Ticket is not recognized by the QR Code reader after activation, the User is requested to contact the transport Operator directly. In the event of failure to activate, the penalties provided by the Operator will apply. Details on the validity, issuance, and conditions of use of Tickets purchased through daAaB are available in the Voucher. The Voucher and the Tickets contained therein are valid only on the device from which the purchase was made and are therefore non-transferable. It is the User's responsibility to ensure the proper functioning of their mobile device during the entire duration of the journey.

Choosing and Purchasing Travel Solutions

Once the User has entered the departure and arrival locations in the designated fields, the available travel Solutions are displayed. By selecting each proposed Solution, the User can view additional and detailed information regarding the journey. The User acknowledges and accepts that daAaB cannot guarantee that the options shown on the Site constitute the entirety of the travel solutions actually existing in reality. Where commercial agreements exist between daAaB and the Operators for the sale of travel tickets, pricing information for the Tickets valid for each Solution is indicated where available. The User can then compose their Voucher (which groups the selected Tickets) and proceed with the purchase using one of the payment methods provided by the Site. Upon receipt of payment, daAaB connects with the Operators' systems to verify the actual real-time availability of the Services included in the chosen Solution. If available, daAaB purchases the electronic Tickets, making them visible to the User within the associated Voucher. If one or more Services are not available from the Operator, the User will be promptly informed and the amount related to the unpurchased portion will be made available in their personal credit for future purchases. Additionally, the User will receive a summary email of the purchase containing a link to access the Voucher at the email address provided during the payment phase. Purchased Tickets may be immediately valid or usable only on pre-established dates and times, as specified in the details of each ticket. Unless otherwise indicated, the same terms of use and validity established by the respective Operators apply to Tickets purchased through daAaB. In the event that the chosen Solution includes Tickets requiring manual activation, it is the User's sole responsibility to activate the respective Ticket by clicking on the dedicated button and to scan the corresponding QR code on the onboard validators. It is also the User's responsibility to ensure that the purchased travel Solution is compatible with their actual transport needs (including connection times for any intermediate transfers, departure and arrival times, and the actual availability of the Operators' service).

Management of Personal Wallet

Registered Users, provided they are logged into their account on the Website, have the option to top up a personal electronic wallet (hereinafter “daAaB Wallet”). The top-up can be carried out using the electronic payment instruments made available on the Website. The daAaB Wallet balance is strictly personal, non-transferable to other users, and can be used exclusively within the Website for purchasing Tickets and Vouchers. The topped-up Wallet is non-convertible into cash and non-refundable, except in cases expressly provided for by mandatory consumer protection regulations.

Type of Data Used and Privacy

daAaB uses data in General Transit Feed Specification (GTFS) format regarding the Services of the various Operators to calculate Solutions. This data can be of three types:

  • generated by daAaB on behalf of the Operators (“Certifeed”);
  • generated by the Operators, the Entities to which they are subordinate, or third parties appointed by them, and made available to daAaB for the provision of its services (“Primary Data”);
  • generated by the Operators, the Entities to which they are subordinate, or third parties appointed by them, and made available to the public in an open format (“Open Data”).

daAaB ensures the correctness and updating of Certifeed-type data, except for any errors, omissions, or deficiencies in the information transmitted to daAaB by the Operators. daAaB cannot be held responsible for errors, omissions, or deficiencies present in Primary Data and Open Data, nor for the lack of updates or absence thereof. daAaB declines any direct or indirect liability for any damages resulting from inaccuracies, errors, or omissions related to the aforementioned data. Operators remain solely responsible for the truthfulness and correctness of the data provided.

Personal data explicitly entered by Users (such as email addresses or account data) will be processed in full compliance with the Website's Privacy Policy and Regulation UE 2016/679 (GDPR). Data related to travel searches and routes, stripped of any identifying elements, will be processed in a strictly aggregated and anonymous form to compile statistics on the use of the Website itself, as well as to analyze transport demand by geographic area, time period, or other parameters, both by daAaB and by third-party partners.

Cancellations, Modifications, and Refunds

Tickets purchased through daAaB are non-refundable by the platform, and the User does not have the right to exercise the right of withdrawal upon purchase, in accordance with the exclusions provided for passenger transport services under the Consumer Code (Articles 47 et seq.). Any request for a refund or compensation related to cancellations, delays, or service disruptions attributable to the Operator must be addressed by the User directly to the transport Operator involved, in compliance with their specific terms of carriage. daAaB is not responsible for any damages or consequences suffered by the User due to the inability to modify or cancel all or part of the purchased Solution.

Responsibilities and Duties of the User

The User must independently purchase Tickets if it is not possible to complete the purchase through daAaB, even if only a part of the Tickets needed to cover the chosen Solution cannot be purchased, or if the User is unable to purchase Tickets through daAaB due to malfunctions of their device or internet network connection. No responsibility or obligation will be assumed by daAaB in relation to the aforementioned Services that cannot be purchased on the Website. Furthermore, it is the User's responsibility to verify that they have purchased the correct type of Ticket adequate for the trip they intend to take, with particular reference to Tickets whose purchase on the Website is made available directly and without the prior choice of a Solution. The User is required to inform themselves about the Conditions of Carriage and the Terms of Use of the Services provided by each Operator within the Solutions they intend to use. The User is required to verify independently whether, with reference to the chosen Solution, it is necessary to obtain permits, authorizations, or visas from the authorities of the destination countries and to obtain them before the start of the journey. daAaB does not provide information regarding the foregoing and is in no way responsible if the User is unable to travel, or suffers any other consequence, due to the lack or irregularity of the documents and acts mentioned above.

Liability of daAaB

daAaB is committed to always ensuring an optimal user experience for Website Users, using data that is as accurate as possible, and increasing the possibilities for Users to purchase Tickets from different Operators. The activity carried out by daAaB within the Service consists exclusively of an intermediary role in the purchase by the User of the Services provided by the Operators. Therefore, daAaB is not responsible for the correct provision of the Services by the aforementioned Operators, who remain solely responsible for the fulfillment thereof. daAaB assumes no liability toward users for any delays, route deviations, or total or partial failure to perform local public transport services due to force majeure and/or for reasons of public order or safety, nor for the interruption or suspension of the local public transport service for reasons beyond its control or outside its domain, such as, by way of example but not limited to: strikes of any kind (whether previously announced or not), riots, high tides, natural disasters, measures taken by competent Authorities, etc.

Intellectual Property

daAaB is an exclusively owned trademark of Protolab srl, as are the domain names daaab.it, daaab.com, daaab.fr, daaab.de, daaab.es, daaab.pt, daaab.co.uk, daaab.org, daaab.net (“Domain Names”). Use of the trademark or Domain Names is not permitted unless previously authorized in writing by Protolab srl. The contents of the Website may not, either totally or in part, be reproduced, transferred, uploaded, published, or distributed in any way without the prior express consent of Protolab srl. The User is not permitted any use of the Website and its contents that is not explicitly allowed under these Terms and Conditions. daAaB reserves the right to interrupt, suspend, and/or revoke access to and use of the Website at any time, by virtue of its unappealable and discretionary decision.

Applicable Law and Exclusive Jurisdiction

The contract between daAaB and the User is governed by Italian law, in accordance with which these General Terms and Conditions must also be interpreted. Exclusive jurisdiction lies with the Italian Judicial Authority, and the exclusive competent forum is the Court of Padua (without prejudice to any mandatory consumer forum, where applicable by law). By using the Website and its features, the User explicitly declares to have read and accepted these terms and conditions.
